Terms of Service

By accessing the Site or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Site.

Kilimy is the seller and merchant of record for every purchase you make through the Site. Your contract of sale for any Product is with Kilimy.

These Terms include an agreement to resolve most disputes through individual arbitration and a waiver of class actions, which you will find in Section 16. If you are a consumer, this does not affect the mandatory rights you hold in the country where you live.

We may revise these Terms at any time by posting an updated version with a new "Last updated" date. Changes take effect when posted. Your continued use of the Site or placement of an order after a change means you accept the revised Terms. It is your responsibility to review the current version before each purchase. No change to these Terms is binding on us unless posted here or agreed by us in writing.

You must be at least 18 years old, or the age of majority where you live, to use the Site or place an order. By using the Site, you represent that you meet this requirement. If you act on behalf of a business or other entity, you represent that you are authorized to bind it to these Terms.

You represent and warrant that you are not located in, a national of, or ordering on behalf of any person in, a country or region subject to comprehensive United States or other applicable sanctions, and that you are not named on any United States government restricted-party, denied-persons, or specially designated nationals list, or any equivalent list of another jurisdiction.

If you create an account, you are responsible for keeping your information accurate and your credentials confidential, and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your account.

Kilimy curates and sells handmade goods produced by verified Moroccan artisans. Some Products are made by one of our verified artisans in their own style, drawing on reference designs. They are original handmade works and are not exact reproductions of any other party's item.

Each order ships with an Origin Passport that documents the artisan who made your piece, their workshop city, and the technique used. We describe verification and origin truthfully and do not overstate them. We will not attribute a Product to an artisan who did not make it. Our origin and verification statements are representations of provenance only and are not warranties of investment value, future resale value, or appreciation.

You agree to use the Site only for lawful purposes and in accordance with these Terms. You will not, and will not permit anyone acting through you to:

• use the Site for any unlawful, fraudulent, deceptive, or unauthorized purpose, or to solicit others to do so;
• infringe or misappropriate any intellectual property, privacy, publicity, or other right of Kilimy or any third party;
• access, search, scrape, crawl, spider, harvest, index, or copy any part of the Site or its data by automated or manual means except through the interface we provide;
• reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or underlying ideas of the Site or any software we provide;
• resell, list, or commercially exploit any Product or any part of the Site without our prior written authorization, or place orders that we reasonably judge to be for resale, dealing, or arbitrage;
• manipulate pricing, interfere with other users, circumvent or attempt to circumvent our pricing, fees, billing, or security;
• introduce any virus, worm, malware, or other harmful code, or impose an unreasonable load on our infrastructure;
• harass, abuse, threaten, defame, or discriminate against any person on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, disability, or any protected characteristic;
• submit false, misleading, or impersonating information, or use a false identity; or
• collect or track the personal information of others, or engage in phishing, pharming, spamming, or unsolicited solicitation.

A breach of this Section is grounds for immediate suspension or termination of your access, without liability to you, and without limiting any other remedy available to us.

Prices are displayed in US dollars (USD). Any sales tax or VAT that applies to your order is shown at checkout before you pay. Import duties and taxes are paid by Kilimy on a Delivered Duty Paid basis, so you will not be charged customs fees on delivery.

Your order is an offer to purchase. A contract of sale is formed only when we dispatch the Product to you. Until then, we may decline or cancel all or part of an order, including where there is an obvious pricing or description error, where stock is unavailable, where we suspect fraud or prohibited resale, or where we are unable to verify your payment or identity. Where we cancel an order for which you have already paid, we will refund the affected amount.

Payment is processed by our third-party payment processor. By providing a payment method, you authorize us and our processor to charge it for the full order amount, including taxes and any disclosed charges, and you represent that you are authorized to use that payment method. We are not responsible for the acts or omissions of any payment processor. We reserve the right to correct any billing error, even after payment has been requested or received.

If you initiate a chargeback or payment dispute that we reasonably determine to be without merit, we may suspend your account and recover the amount, together with reasonable costs, to the extent permitted by law.

Products ship from Morocco by courier with tracking. Typical transit is 2 to 7 business days after dispatch. Delivery windows are estimates, not guarantees, and do not include time held in customs or delays beyond our reasonable control.

For international shipments, you authorize Kilimy and its carriers and customs agents to act on your behalf as needed to clear and deliver your order, including preparing and filing customs documentation and arranging payment of any duties and taxes that we have undertaken to cover. We are not responsible for the accuracy of tariff classifications assigned in this process and are not liable for penalties arising from them, except to the extent caused by our own breach.

If you are a consumer, risk of loss passes to you when the Product is delivered to you. Title to the Product passes on delivery and full payment.

We offer a 14-day, no-questions-asked return on every order, for every customer, wherever you live. If you change your mind, email support@kilimy.com within 14 days of delivery, return the Product in its original and unused condition, and we will refund the price to your original payment method once we receive it. For a change-of-mind return you cover return shipping.

If your Product arrives damaged or faulty, email support@kilimy.com within 48 hours of delivery with photographs of the packaging and the item. We will resolve it promptly with a replacement or full refund, and we cover the cost.

Two narrow exceptions to the 14-day return apply: Products made to your order or personalized to your specifications, and items clearly marked final sale at the time of purchase. Nothing in this Section limits any statutory right you hold as a consumer, which is preserved in full.

Our Shipping and Returns page sets out the practical steps for starting a return. Where that page and these Terms differ, these Terms and your statutory rights prevail.

Our Products are handmade. Natural variation in color, size, texture, weight, grain, and finish between one piece and the next is inherent to the craft and is not a defect. Screen and device settings affect how colors appear, so the Product you receive may differ slightly from the image shown online. Any dimensions, weights, or descriptions are provided in good faith and may vary within ordinary handmade tolerances.

The Site and all of its contents, including the Kilimy name and marks, text, graphics, photographs, the look and feel, the Origin Passport materials, and all related software, are owned by Kilimy or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to access and use the Site for your own non-commercial purposes in accordance with these Terms.

You may not copy, reproduce, modify, create derivative works from, distribute, publicly display, frame, sell, license, reverse engineer, or otherwise exploit any part of the Site or its contents without our prior written consent. Artisan names, stories, portraits, and imagery may not be reused without consent. All rights not expressly granted are reserved.

If you submit content to the Site or to us, including reviews, comments, photographs, or other materials ("User Content"), you remain responsible for it, and you grant Kilimy a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable, and transferable license to host, store, reproduce, adapt, publish, translate, distribute, and display that User Content in connection with operating, marketing, and promoting the Site and the Products, across any media now known or later developed.

If you publicly share images of any Product on social media using our marks, name, or a related hashtag, you grant Kilimy the same license described above to use those images for marketing, without further consent or compensation.

You represent and warrant that you own or control all rights in your User Content, that it is accurate, and that it does not infringe any third-party right or violate any law. Any feedback, ideas, or suggestions you provide become our property, may be used by us for any purpose without compensation or obligation of confidentiality, and are provided without restriction.

We may, but are not obliged to, monitor, screen, edit, or remove any User Content at our sole discretion, including content we consider unlawful, infringing, or objectionable.

We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms and explains what we collect, why, how long we keep it, and the rights you hold. Depending on where you live, those rights may arise under the EU General Data Protection Regulation, the UK General Data Protection Regulation, the California Consumer Privacy Act as amended, or other applicable data-protection law, and may include rights of access, correction, deletion, portability, and objection.

Where we transfer personal data across borders, we rely on lawful transfer mechanisms as required by applicable law. By using the Site, you acknowledge our Privacy Policy. You can review how we handle your personal data, and exercise your rights including access and deletion, through our Privacy Policy or by emailing privacy@kilimy.com.

The Site relies on third-party providers, including payment processors and carriers, and may contain links to third-party websites. These services and sites are governed by their own terms and privacy policies, which we do not control. We provide them for convenience and make no representation about them. To the fullest extent permitted by law, we are not responsible or liable for any third-party service, site, or transaction, and you use them at your own risk.

To the fullest extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, timely, or error-free, or that any defect will be corrected.

Nothing in this Section affects any non-excludable warranty or statutory guarantee that applies to consumers under the mandatory law of their country, including the statutory rights described in Section 7. Some jurisdictions do not allow certain warranty exclusions, so parts of this Section may not apply to you.

To the fullest extent permitted by applicable law, Kilimy and its officers, owners, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Site or any Product, under any theory of liability, even if advised of the possibility.

To the fullest extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to a Product or order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any non-waivable rights you hold as a consumer in your home country. Where the law of your country gives you remedies that cannot be limited, those remedies apply notwithstanding this Section.

To the extent permitted by law, you agree to indemnify and hold harmless Kilimy and its officers, owners, employees, and agents from any claims, liabilities, damages, losses, and reasonable costs, including legal fees, arising out of or related to your breach of these Terms, your misuse of the Site, your User Content, or your violation of any law or third-party right. This does not apply to any loss caused by our own breach, negligence, or wilful misconduct.

Your relationship with us has distinct layers, and each is governed accordingly.

Consumers. If you are a consumer, you keep every mandatory consumer-protection right of the country where you live. Nothing in these Terms removes rights you cannot waive under European Union law, United Kingdom law, or the law of your United States state, including California. You may bring a claim in the courts of the place where you live where your local law gives you that right, and the arbitration and class-waiver provisions below do not apply to you to the extent the mandatory law of your country prohibits them.

United States users and business relationships. Except as carved out above, these Terms and any dispute arising out of or relating to them or the Site are governed by the Federal Arbitration Act and the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules, and the United Nations Convention on Contracts for the International Sale of Goods does not apply. You and Kilimy agree to first attempt to resolve any dispute through good-faith negotiation. If that fails, the dispute will be resolved by binding individual arbitration administered under the streamlined rules of a recognized arbitration provider, seated in Wyoming, and conducted in English before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. All claims must be brought on an individual basis and not as a plaintiff or class member in any class or representative action. If this waiver is found unenforceable as to a particular claim, that claim, and only that claim, will proceed in court rather than arbitration.

Opt-out. You may opt out of arbitration by emailing support@kilimy.com with a clear statement to that effect, and the email and order details associated with your account, within 30 days of first accepting these Terms.

Exceptions. Either party may bring a qualifying claim in small-claims court, and either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property.

Relationships with artisans and suppliers are governed by the laws of Morocco.

We may suspend, restrict, or terminate your access to the Site at any time, with or without notice, for any breach of these Terms, suspected fraud or unlawful activity, non-payment, legal or security reasons, or discontinuation of the Site. You may stop using the Site at any time. Termination does not affect any order already dispatched or any amount already owed. Provisions that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution, will survive.

We respect intellectual property and ask you to do the same. If you believe content on the Site infringes your copyright or trademark, send a notice to support@kilimy.com with the subject line "IP Complaint," identifying the protected work or mark, the allegedly infringing material and its location, your contact information, a good-faith statement that the use is unauthorized, and a statement, made under penalty of perjury, that your notice is accurate and that you are authorized to act for the rights holder. We may remove the material, notify the affected party, accept a counter-notice, and terminate access for repeat infringers, in our discretion and in accordance with applicable law. We may request further information and may reject complaints we reasonably believe are false, incomplete, or made in bad faith.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, customs action, labor disputes, failures of networks or utilities, natural events, epidemics, or acts of government.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our consent. We may assign ours to a successor or affiliate without reducing your rights.

Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

No agency. Nothing in these Terms creates any partnership, agency, employment, or joint venture between you and us.

Entire agreement. These Terms, together with the Privacy Policy and the Shipping and Returns page, are the entire agreement between you and us about your use of the Site, and supersede any prior understanding on that subject.

Language. These Terms are written in English, which governs in the event of any conflict with a translation.
